VIEW ORDINANCE 3581

** NEW ** Residential Tier 1 - 3rd Quarter Sewer Bill Averaging

We understand that many residents are concerned about being charged sewer fees for water that
does not enter the sanitary sewer system, such as water used for lawn sprinklers,
gardening, or filling swimming pools during the summer.

In response to this concern, the Township has amended its sewer ordinance to establish a fairer approach to
calculating third-quarter sewer charges, when outdoor water use is typically at its peak.

Beginning this year, the third-quarter sewer charge will be based on the average water consumption from
the previous four quarters. This new method reflects your typical indoor water use, helping
to ensure that sewer charges more accurately match the amount of water entering the sewer system.

We appreciate the community’s input on this issue and remain committed to fair and transparent utility billing practices.

If you have questions or need assistance understanding how this change affects your bill,
please contact the Water & Sewer Department.

Solicitation for Water & Sewer Line Protection Insurance

The Nutley Department of Public Works has recently been made aware of a solicitation from
American Water Resources regarding water and sewer line protection insurance.

It is important to note that American Water Resources is in no way affiliated with the Township of Nutley
and the Township DOES NOT ENDORSE any service line warranty programs.

As with any insurance or warranty program, it is important for individuals to conduct their own due diligence.
This entails at a minimum thoroughly understanding what is covered, what is not covered, and any exceptions that may apply.

Important Information About Your Drinking Water

Lead Service Line Inventory

The Township of Nutley actively seeks to ensure that lead and copper are not found in our public community water system in detectable levels. As part of an effort to comply with the regulations and requirements of the Federal Lead and Copper Rule and P.L.2021, Ch. 183, the Township of Nutley has compiled this inventory of service line information. The inventory will be regularly updated as the Township continues to investigate the composition of service lines throughout the Township. Service lines in the Township have two parts: the portion owned by the Township of Nutley from the main to the curb box, and the customer owned portion from the curb box to the water meter.

About the Nutley Water and Sewer Utility

The Nutley Sewer Utility is a newly established entity that combines with the existing Nutley Water Utility to provide a fair and equitable mechanism for property owners to pay for the cost of wastewater treatment and the maintenance and improvement of Nutley’s sewer infrastructure. This change took effect on July 1, 2024.

The Nutley Water and Sewer Utility is a division within the Department of Public Works and operates solely on revenues received for the services rendered. This means tax dollars are not necessary for this utility to function under normal conditions.

Nutley receives the majority of its potable water from the Passaic Valley Water Commission (PVWC). Its main facility is the Little Falls Water Treatment Plant in Totowa, NJ. Water is diverted from the Passaic and Pompton Rivers, is treated, filtered and disinfected at the plant. In drought conditions or other emergency, water from the Point View Reservoir in Wayne, NJ can be used to supplement river sources. Treated water is then mixed at PVWC’s main pumping station with treated water from the North Jersey District Water Supply Commission’s Wanaque Reservoir treatment plant. Water is then pumped into underground transmission lines running through Nutley. Nutley has four (4) intake pit areas along this transmission line. At these intakes, the water goes into our distribution system. The water is then conveyed into all homes or businesses connected to the system.

The City of Newark serves a small area of Nutley with Pequannock Reservoir Water. This area is located west of Ridge Road and Van Winkle Avenue and bordered by Glenview Road, the Township of Nutley/Bloomfield boundary line and East Passaic Avenue.

The Nutley Water Department is a public community water system and purchases water from the following water systems:

  • Passaic Valley Water Commission - PWSID # NJ1605002
  • North Jersey District Water Supply Commission - Wanaque North System - PWSID # NJ1613001
  • Newark Water Department - PWSID # NJ0714001
