NOTICE TO BIDDERS
Notice is hereby given that sealed bids will be received by the Township of Nutley for "2025 CDBG Township Roadway Improvements - Van Winkle and San Antonio Avenue,” Contract No. NTLYT26103 and will be opened and read in public at the First Floor Conference Room, Nutley Township Hall, One Kennedy Drive, Nutley, NJ, 07110 on Wednesday, July 29, 2026, at 11:00 AM prevailing time.
The work includes the furnishing of all labor, material and equipment necessary or required to complete all work set forth in these Specifications. Plans, Specifications and forms of bid for the proposed work prepared by Pennoni Associates, Municipal Engineers, and approved by the Township of Nutley have been filed at the Township of Nutley Purchasing Department at One
Kennedy Drive, Nutley, New Jersey 07110 (Telephone No. 973-284-4960) and may be inspected by prospective bidders during regular business hours beginning July 17, 2026. Bidders will be furnished with a copy of the Specifications and Proposal by the Nutley Purchasing Department for $25.00, cost of preparation thereof, non-refundable; plus $5.00 postage and handling, if mailed. Checks shall be made payable to the Township of Nutley. A copy of the Plans and Specifications are available for review only at the Municipal Engineer’s (Pennoni Associates Inc.) office.
Bids must be made on the standard Proposal form in the manner designated therein and must be enclosed in a sealed envelope bearing the name and address of the bidder and the name of the project on the outside, addressed to the Township of Nutley, and must be accompanied by a Certified Check, Bid Bond or Cashier's Check drawn to the order of the Township of Nutley for ten percent (10%) of the total amount bid, provided said security need not be more than $20,000.00. All bid guarantees shall be accompanied by an executed consent from an approved surety company, licensed to conduct business in the State of New Jersey, agreeing to furnish the required Performance and Maintenance Bond upon the award of contract.
The signed Proposal forms and bid security must be delivered to the address named above on or before the hour named above. The accepted bidder must sign the contract within ten (10) days after the Notice of Award or forfeit his bid security. Bid securities will be returned to all but the three apparent lowest responsible bidders. All other bid securities will be returned after awarding and signing of the contract and approval of the Contractor's Performance Bond.
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 for Equal Employment Opportunities.
The right is reserved to reject any or all Proposals, in whole or in part, or to make awards to such bidder or bidders, who, in the judgment of the Township of Nutley makes the most advantageous bid and to waive such informalities as may be permitted by law.
The contract governing this work is funded by monies received by Essex County under Title I of the Housing and Urban-Rural Recovery Act of 1983 (P.L. 98-181). Under the said Act, the Davis-Bacon Act is applicable to the contracted work. Accordingly, the contractor must abide by the provisions of the Federal Labor Standards which are included as a part of the conditions of this contract.
The Federal Labor Standards found in this section shall take precedence over any contradicting condition and provisions found within the previous sections of this specification. All forms found in this section must be completed and submitted as part of the sealed bid which will be received by the Township of Nutley on or before July 29, 2026 at 11:00 AM prevailing time. Failure to complete the forms found in this section may result in a rejection of bid.
