The Township of Nutley Board of Commissioners has prepared the following Frequently Asked Questions regarding the construction of a potential data center at the ON3 site, located at 275 Kingsland Street:

Litigation History

Following Hoffman LaRoche’s closure of its campus in Nutley and Clifton, its campus was purchased by a developer, Prism, and marketed as ON3.  It is important to note that Hoffman LaRoche generated approximately ten percent of Nutley’s tax revenue.

Nutley and Clifton declared the former Hoffman LaRoche campus an area in need of redevelopment and designated Prism as the redeveloper. Thereafter, numerous lawsuits were filed by and between Prism, Nutley and Clifton and several rulings in those lawsuits were against Nutley. One of those rulings allowed Prism to proceed with its application to construct a trucking terminal on Kingsland Avenue. We did not want a trucking terminal on Kingsland Avenue, and we also wanted to stop the litigation and the payment of legal fees.

Following several months of negotiations, we reached a comprehensive settlement agreement with Prism that will allow the former Hoffman LaRoche campus to be further redeveloped and generate additional revenue for Nutley. The settlement agreement contemplates the construction of a data center or other uses, including assisted-living facilities, offices, science and clinical laboratories, storage facilities, research laboratories, active and passive recreation, or open space on Kingsland Avenue.

Has a data center been approved for 275 Kingsland Street?

The Township has not received an application for the construction of a data center at 275 Kingsland Street.

If no application has been received or approved, why has there been discussion about a data center?

Prism placed a sign at the site advertising it as available for a data center.  The sign led to residents requesting information about the development of the site as a data center.

Will residents have an opportunity to participate and comment if an application is submitted to the planning board?

If the developer files an application for the construction of a data center, the application will be heard by the planning board.  The planning board will evaluate the application pursuant to New Jersey’s Municipal Land Use Law and residents will be able to participate in the planning board hearings.

How does the Governor’s data center initiative impact any application?

Governor Sherrill has announced a comprehensive statewide plan to address data centers’ impact on energy, resources and local communities. Her plan includes “four pillars” of responsible construction and operation of data centers.

• Establishing statewide rules to ensure data centers bring new clean energy online and contribute to the infrastructure needed to support their growth, shifting costs away from residents and ratepayers.
• Public reporting of energy and water use to provide the public with visibility concerning energy and water impacts.
• Developing statewide standards for community benefit agreements to ensure that data center owners and operators address light, noise, and pollution and also make a meaningful investment in the community where they operate.
• Delivering good-paying jobs by ensuring that data centers pay prevailing wages.
